The main challenges in this area are closely related to the way in which the exchange of information and data moves today and the rapid access that we can all have to it; therefore, the protection of rights and regulation must progress at the same speed. One of the topics that generates great challenges is artificial intelligence, instruments created by humans that generate information and that in turn can be converted into intellectual property rights.

In addition, the collection of data, which ranges from the interests of a person or group of people to the ability to make those interests influence decision-making that affects, positively or negatively, a large part of society.

In addition, we focus on banking entities on issues related to information technology and the management of their industrial property.

Relevant Cases

  • Jiménez Peña advised, represented and assisted Dominican Food Investments, S.A., an entity that is part of CCS Holding Group Limited in the analysis, drafting and execution of nullity actions against distinctive signs that violate their rights in relation to the distinctive signs of the brand «Pechurinas», one of the main assets of Dominican Food Investments, S.A. The participation of Jiménez Peña before the competent authorities led to the nullification or cancellation of most of the registered distinctive signs that were not part of the CCS Holding Group Limited trademark portfolio, declaring our client as the exclusive owner of the same.
  • Jiménez Peña advised Adevinta Holdco Spain, S.L. and Adevinta Iberica, SL, entities that are part of the Adevinta Group, with the structuring and sale of its participation in the Dominican subsidiary that owns and operates www.corotos.com.do, one of the main E-Commerce Platforms in the Dominican Republic, to a group of local investors.   • Jiménez Peña participated in the purchase project of 45% of the Caucedo Multimodal Free Zone by Caisse de Dépôt et location du Québec, through its subsidiary CDP Groupe Infrastructures Inc. The operation consisted of the purchase of the shares of Caucedo Development Corporation. As part of the due diligence process, Jiménez Peña reviewed all the Intellectual Property involved in the purchase process of the shares of the Caucedo Multimodal Free Zone, which involved (but was not limited to) an exhaustive review of the Information Technology Agreements (IT), Software License Contracts, as well as the portfolio of distinctive signs that would be part of the transaction;
  • Jiménez Peña advised, reviewed and analyzed everything necessary to assist Trabardur Investments / Bia Brands in the process of obtaining all the sanitary registrations of imported food and beverages, mainly products of said company, before the competent entities, as well as the portfolio of brands in the Dominican Republic.
  • Representation of V Energy, S.A., a subsidiary of Total Dominicana in the due diligence process for the acquisition of the majority shareholding of Plater Investment, S.A., a natural gas distribution company, which included the review of all intellectual property in due diligence, rights that would be part of the transaction between these companies, portfolio of distinctive signs that would be part of the transaction, license agreement for distinctive signs, agreements for the assignment of distinctive signs, among others.
